O1 NG committed adultery with a E3 reservist while TDY?

My husband is a 2LT in the National Guard and he committed adultery with a female PFC who was in the reserves while he was TDY is there a penalty for this? Could he be under UCMJ? She is not under his COC. I need advice. I want him to pay.
